MIRANDA

The most basic right when questioned by police or agents is to remain silent and the right to an attorney. Exercise these rights even if you are not arrested. Police may not necessarily read you these rights. It is up to you to assert these rights and protect yourself.

THE RIGHT TO REMAIN SILENT

Police/agents use questioning and your own statements to strengthen their case against you. If you answer questions, police can misinterpret your answers, add facts or outright make up facts you did not say. Once in court, it is their word against yours. The best advice is to remain silent and DO NOT speak with police/agents, without the assistance of an attorney.

Many people try to be polite, helpful and may even believe police will be easy on them if they tell the truth. Do not believe this!!! Police will lie, make promises and use all sorts of techniques to get you to talk. Police may ask questions that seen harmless. Your answers can lead to a conviction based on your own admissions. If you admit anything that gives them the ability to charge you with a crime, police will file charges and try to convict you with your own words.

THE RIGHT TO AN ATTORNEY

Most people believe they can handle themselves while speaking with police. Even after they are read the Miranda Rights, people continue to speak to police without the assistance of an attorney. Often, people dont know any attorneys or do not think they can afford an attorney or think police will be harder on them if they have an attorney. THIS DECISION IS A MISTAKE. Police will use your own statements to charge you. If you are suspected of a crime, demand to speak to an attorney. A request an attorney, stops the questioning and protects you.

SEARCHES AND SEIZURES

The 4th Amendment to the U.S. Constitution, guarantees your rights against unreasonable searches and seizures. If contacted by the Police, do not give permission to search your car, your home, your bags or your person. Permission allows police to get around the need for a warrant or probable cause. Even if you are arrested, never give permission to search. Never sign a paper allowing a search.
